End User Licence Agreement

This End User Licence Agreement ("Agreement") is a legal contract between you ("User") and TrailWise ("we," "us," or "our") governing your use of the TrailWise mobile application ("App"). By downloading, installing, or using the App you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. Licence Grant

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any device that you own or control, solely for your personal, non-commercial purposes and in accordance with this Agreement.

2. Age Requirement

You must be at least 13 years old to use the App. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Subscriptions and In-App Purchases

3.1 TrailWise Pro — Auto-Renewable Subscription

The App offers the following auto-renewable subscription:

• Title: TrailWise Pro
• Subscription length: Monthly (renewed every 30 days) or Annual (renewed every 12 months), as selected at the time of purchase.
• Price: As displayed in the App at the time of purchase. Prices may vary by region and are shown in your local currency inclusive of applicable taxes.

3.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time in your device's App Store account settings. Cancelling your subscription does not provide a refund for the current billing period; you will continue to have access to Pro features until the end of the period you have paid for.

3.3 Free Trial

Where a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription. After the free trial ends, your payment method will be charged the applicable subscription price unless you cancel before the trial period ends.

3.4 Price Changes

We may change subscription prices at any time. If we increase the price of your current subscription, we will notify you in advance and give you the opportunity to cancel before the new price takes effect.

3.5 Payments

All payments are processed by Apple (iOS) or Google (Android) through their respective app store platforms. We do not collect or store your payment information directly. Any billing disputes should be directed to the relevant app store.

4. User-Generated Content

You retain ownership of any routes, logs, notes, or other content you create in the App. By submitting content you grant us a worldwide, royalty-free licence to use, reproduce, and display it solely to provide the App's services to you and other users. You are solely responsible for ensuring your content does not infringe the rights of any third party.

5. Prohibited Conduct

You agree not to:

• Copy, modify, distribute, sell, or sublicence any part of the App;
• Reverse-engineer, decompile, or disassemble the App;
• Use the App for any unlawful purpose or in violation of any applicable law;
• Attempt to gain unauthorised access to any part of the App or its underlying systems;
• Upload content that is harmful, offensive, or infringes any third-party rights.

6. Location Data

The App requests access to your device's location to display your position on the map, track hikes, and navigate to summits. You may grant or revoke this permission at any time through your device's settings. Location data is processed in accordance with our Privacy Policy.

7. Intellectual Property

The App and all content provided by us (excluding your User-Generated Content) remain the exclusive property of TrailWise or its licensors and are protected by copyright, trade mark, and other intellectual property laws. Nothing in this Agreement transfers any intellectual property rights to you.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. Outdoor activities such as hiking carry inherent risks. The App is a supplementary tool and must not be relied upon as your sole means of navigation. Always carry appropriate maps, equipment, and observe relevant safety guidance.

9. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or personal injury, arising from your use of the App. Our total aggregate liability under this Agreement shall not exceed the amount you paid for the App or its in-app purchases in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time if you breach this Agreement. On termination you must cease all use of the App and delete all copies in your possession.

11. Changes to this Agreement

We may update this Agreement from time to time. We will notify you of material changes within the App or by email. Continued use of the App after the effective date of any changes constitutes your acceptance of the revised Agreement.

12. Governing Law

This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Privacy Policy and Terms of Use

Your use of the App is also governed by our Privacy Policy and Terms and Conditions, each of which is incorporated into this Agreement by reference.
